By Signing this release agreement, I acknowledge that dog training may involve risks to myself, members of my family, my dog, other dogs, wildlife, any dog trainer, and all those present during such training.

From this day forward, I agree to indemnify the owners of "The Property" 2270 Cliff Ave Unit 100, Courtenay BC V9N 2L4, and ALL THINGS DOG ROOM; Nicole Ryan and Paige Dombroski, employees, instructors, representatives, contractors, subcontractors, suppliers, sponsors, successors and assigns (all of whom are hereinafter referred to as "The Releasees") for any and all costs, both direct and indirect arising from such an incident.

I assume all risks associated with ACTIVITIES at "The Property" 2270 Cliffe Ave unit 100, Courtenay, BC V9N 2L4, and ALL THINGS DOG ROOM. This includes all activities, events or services provided, arranged, organized, conducted, sponsored or authorized by the Releasees and includes, but is not limited to: dog training, dog events, dog instructional courses, dog conditioning and physiotherapy, classes, workshops, seminars, rental and/or use of dog training equipment, storage and distribution, meetings, indoor and outdoor training, and social events, (The "Activities").

These risks include injury or infection to myself, members of my family, my dog, other's dogs, wildlife, any dog trainer, property and all those present during such training.

I acknowledge that dogs can be unpredictable and there are certain risks and dangers inherent to being around them.

Upon request, I agree to provide the required Veterinary Certificate stating that my dog is healthy, has had proper veterinary examinations and has received the preventative health care requirements to attend Puppy Class, or any other training classes or services run by ALL THINGS DOG ROOM. It is my responsibility to keep my dog current on vaccinations or titers. I recognize that dogs may still be susceptible to various diseases or infections despite being vaccinated and may infect me or my dog.

If my dog causes property damage, bites or injures any other dog, animal or person during or after the term of this Agreement, then I agree to defend and indemnify ALL THINGS DOG ROOM and the RELEASEES from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If my dog is injured in a fight or in any other manner during or after the term of this Agreement, I assume the risk and agree that ALL THINGS DOG ROOM and RELEASEES should not be held responsible for any resulting injuries, losses, damages, expense or physical injury, including death DUE TO ANY CAUSE WHATSOEVER, including negligence, breach of contract, or breach of any statutory or other duty of care, including any duty of care owed under the occupiers liability act, on the part of the Releasees, and further including the failure on the part of the Releasees to safeguard or protect me from the risks, dangers and hazards of participating in the "Activities" referred to above;

I have read and agree to ALL THINGS DOG ROOM'S General requirements as outlined in General requirements on their website.

ALL THINGS DOG ROOM is not responsible for refunds for any failure to hold classes, seminars or any event if it is prevented or delayed in performing those obligations by an event of force majeure (any act of God, including epidemics).

I understand that there will be no refunds of tuition after the second-class meeting. I also understand that there are no regularly scheduled make up sessions and that if I miss a class meeting the course instructor may update me by email.

I hereby agree and covenant myself, my heirs, executors, administrators and anyone else who may claim on my behalf to waive, release and discharge ALL THINGS DOG ROOM and Releasees from any and all claims arising out of or in connection with or in any way related to the use of ALL THINGS DOG ROOM.

This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia; and Any litigation involving the parties to this Release Agreement shall be brought solely within British Columbia and shall be within the exclusive jurisdiction of the Courts of British Columbia.

If any provision of this Release shall be held by a court of competent jurisdiction to be invalid, unenforceable or void, the remainder of this Release Agreement shall remain in full force and effect.

I grant permission to ALL THINGS DOG ROOM to use my pet's photograph(s) and or video(s) taken for educational and promotional purposes in any type of media. ALL THINGS DOG ROOM shall be the exclusive owner and retain rights to the results and all proceeds of such media. Any pictures, video, or other media taken in or at ALL THINGS DOG ROOM remains the property of ALL THINGS DOG ROOM, and is not permitted to be used to advertise any service not provided by ALL THINGS DOG ROOM, except without express permission from the owner(s).If permitted all media must include credit, naming ALL THINGS DOG ROOM as the location.

I agree to not share my access to the building unless approved by ALL THINGS DOG ROOM in advance. I will follow the steps for opening and closing the training room as posted. I agree that I will not leave any dog unattended in the training room at any time. I will use the equipment in the room with due care and respect and inform ALL THINGS DOG ROOM of any damages or safety concerns found or created. I agree to always clean up after myself and my dog.

This waiver is in effect once agreed to by checking the consent checkbox, regardless of the date, time or year. I acknowledge having read & understood this Liability Release form by checking the waiver checkbox below, that I am the legal owner of the dog(s) in attendance and that I am over 19 years, and that this agreement is binding. The acceptance of this hold harmless waiver is for myself, my dogs and any family members or guests that are accompanying me to any class seminar or any event at ALL THINGS DOG ROOM.

In entering into this Release Agreement, I am not relying on any oral or written representations or statements made by, or on behalf of, the Releasees with respect to the safety of participating in the Activities, other than what is set forth in this Release Agreement.

BY SIGNING THIS RELEASE AGREEMENT, YOU WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION AS THE RESULT OF AN ACCIDENT AND/OR INJURY.

THIS DOCUMENT MAY BE USED AGAINST YOU IN A COURT OF LAW.

YOU MAY NOT PARTICIPATE IN ANY ACTIVITY AT ALL THINGS DOG ROOM UNTIL YOU HAVE SIGNED THIS RELEASE.

7. I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS RELEASE AGREEMENT PRIOR TO SIGNING IT. I AM AWARE THAT BY SIGNING THIS RELEASE AGREEMENT, I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.

8. I FURTHER ACKNOWLEDGE THAT I AM AT LEAST NINETEEN (19) YEARS OF AGE, MENTALLY COMPETENT AND NOT UNDER ANY FORM OF DURESS OR UNDUE INFLUENCE AT THE TIME OF EXECUTION OF THIS RELEASE AGREEMENT. IF YOU ARE UNDER 19 YEARS OLD WHEN COMPLETING THIS FORM, THE PARTICIPANT MUST GET THE SIGNATURE OF HIS/HER PARENT OR LEGAL GUARDIAN.
